If you’re an employer who routinely recruits overseas workers, you’ll need to be registered as an accredited employer with Immigration New Zealand. Accreditation is a compliance-focussed regime which places various responsibilities on an employer’s business and requires record-keeping for potential auditing. To become accredited, employers must declare that they meet (and will continue to meet) various business, employment law and immigration law requirements. They are able to select to have either Standard accreditation (allowing employment of up to 5 migrant workers at any one time), or High-volume accreditation (allowing employment of 6 or more migrants at any one time).
The Immigration Advisers Licensing Act 2007 also affects the kind of immigration advice that employers can give their prospective employees. Even ‘in-house’ immigration advice from an unlicensed staff-member to overseas employees is now prohibited by law.
